These Conditions or Terms of Sale (CToS) define the terms and conditions applicable to the services offered by FXeffect, a company specializing in stage special effects.
FXeffect provides comprehensive services including:
– Technical and artistic study,
– Supply and installation of equipment,
– Live operation and management of special effects (e.g., stage flames, CO₂ geysers, confetti, streamers, pyrotechnics, etc.).
FXeffect does not offer simple equipment rental without an operator.
Each service is subject to a detailed and personalized quotation.
An order becomes final upon receipt of the quotation signed by the client, accompanied—if specified—by a 30% deposit.
Prices are expressed in euros, including VAT, and may vary depending on the complexity, duration, and location of the event.
The remaining balance must be paid under the conditions specified in the quotation.
In case of cancellation by the client:
– More than 30 days before the service date: refund of the deposit minus any expenses incurred.
– Less than 30 days before the service date: the deposit remains non-refundable and acquired by FXeffect.
Any major modification to the project must be confirmed in writing and may result in a revised quotation.
FXeffect undertakes to perform its services in compliance with all applicable safety standards, using professional and compliant equipment.
The client agrees to provide safe and unrestricted access to the venue, to obtain all necessary authorizations (e.g., from the city hall or prefecture), and to follow the safety instructions provided by FXeffect.
FXeffect cannot be held liable in the event of force majeure or any unforeseen circumstance that makes the performance of effects impossible or unsafe (e.g., weather conditions, administrative decisions, or unexpected equipment failure despite regular maintenance).
FXeffect and its partners hold professional liability insurance covering both services and equipment.
These CToS are governed by French law.
In the event of a dispute, jurisdiction shall lie with the courts of FXeffect’s registered office, unless otherwise required by law.
The signature of the quotation constitutes full and unconditional acceptance of these Conditions or Terms of Sale (CToS) by the client, without reservation.
