General Conditions of Sale (CToS)

1. Purpose

These General Terms and Conditions of Sale (GTCS) define the terms and conditions applicable to services provided by FXeffect, a company specialized in the design and execution of stage special effects and pyrotechnic effects for public and private events.

Any order implies full and unconditional acceptance of these GTCS.


2. Services Provided

FXeffect provides complete services including in particular:

– Technical and artistic project study
– Supply, transport and installation of the required equipment
– Live operation and management of special effects by qualified operators
– Dismantling and removal of equipment after the event

The effects provided may include, but are not limited to: CO₂ jets, spark effects, confetti, streamers, atmospheric effects, pyrotechnic effects and other special effects devices.

FXeffect does not offer equipment rental without an operator.


3. Orders and Quotations

All services are subject to a detailed and personalized quotation.

An order becomes firm and binding upon receipt of:

– the quotation signed by the client
– and payment of the deposit indicated on the quotation.

FXeffect reserves the right to refuse a service if technical or safety conditions cannot be guaranteed.


4. Pricing and Payment Terms

Prices are expressed in euros including all taxes (TTC) and may vary depending on the nature of the service, technical complexity, duration of operation and location of the event.

Unless otherwise stated in the quotation:

– a 30% deposit is required upon confirmation of the order
– the remaining balance must be paid before or on the day of the event.

Late payment may result in suspension or cancellation of the service.


5. Consumables and Pyrotechnic Products

Consumables and products required for the performance of special effects (including pyrotechnic materials, confetti, CO₂ cartridges, charges, etc.) are ordered and prepared specifically for the client’s event.

These products are therefore invoiced for the scheduled event date and cannot be refunded once ordered.

In the event that the service cannot be performed for reasons beyond the control of FXeffect (including weather conditions, safety constraints or administrative decisions), the consumables will remain the property of FXeffect.

They may be used for a rescheduled performance for the same client, without additional invoicing for those products.


6. Weather Conditions and Safety

The execution of certain special effects and pyrotechnic displays depends directly on weather conditions.

In the event of unfavorable or dangerous weather conditions (including strong wind, heavy rain, storms, excessive heat, drought, or similar conditions), FXeffect reserves the right to:

– modify the planned effects
– postpone the performance
– cancel all or part of the effects or pyrotechnic firing.

For safety reasons, FXeffect remains the sole decision-maker regarding whether special effects or pyrotechnic effects can be performed, based on professional assessment and applicable safety standards.

Such decisions shall not give rise to any liability for FXeffect.


7. Safety Distances and Installation Conditions

The execution of special effects is subject to strict compliance with safety distances and applicable technical regulations.

The client agrees to provide a suitable space allowing the required safety distances between:

– the firing or installation area
– the audience
– buildings
– vehicles
– any installation or obstacle.

If safety conditions cannot be guaranteed (insufficient distance, unexpected obstacles, presence of the public within safety zones, etc.), FXeffect reserves the right to modify or cancel all or part of the effects.


8. Crowd Management and Safety Interruption

The client or event organizer is responsible for ensuring that the audience remains outside the safety zones defined by FXeffect.

In the event of intrusion into these zones or any situation presenting a safety risk, FXeffect reserves the right to immediately interrupt the performance for safety reasons.

FXeffect shall not be held liable in such circumstances.


9. Administrative Authorizations

The client is responsible for obtaining all necessary authorizations required for the event, including those from local authorities (municipality, prefecture, venue management, etc.), unless otherwise specified in the quotation.

FXeffect may assist the client with certain administrative procedures if included in the service.


10. Cancellation and Modifications

In the event of cancellation by the client:

– more than 60 days before the event: the deposit will be refunded minus expenses already incurred
– less than 60 days before the event: the deposit remains retained by FXeffect.

Any significant modification to the project (location, schedule, type of effects, technical setup) must be validated in writing and may result in a revision of the quotation.


11. Insurance

FXeffect maintains professional liability insurance covering its services, personnel and equipment within the scope of its activities.


12. Governing Law and Jurisdiction

These GTCS are governed by French law.

In the event of a dispute and failing amicable resolution, jurisdiction shall fall to the competent courts of the registered office of FXeffect, unless otherwise required by law.


13. Acceptance of the GTCS

The signing of the quotation by the client constitutes full and unconditional acceptance of these General Terms and Conditions of Sale.
